The Principles of Corporate Governance require that business conduct conform to the law. In recent years, news reports of business misconduct have cast doubt on a conclusion that conformity is the prevalent practice. This article explores the influence of law on business conduct by comparing the law’s requirements and purposes with actual business conduct in the market. Specifically, it explores whether certain legal regimes are more effective than others in inducing greater commitment to legal compliance by corporate actors. The conclusion (...) drawn is that the prevalent legal regime – a vague common law or legislative mandate – is typically associated with corporate conduct that evades or ignores the law’s mandate or its underlying purpose. Leggett formulated an inequality that seems to generalize the Bell theorem to non-local hidden variable theories. Leggett inequality is violated by quantum mechanics, as was confirmed by experiment. However, a careful analysis reveals that the theory applies to a class of local theory. Contrary to what happens in the derivation of Bell inequality, it is not necessary to make the hypothesis of outcome independence to derive the Leggett inequality.

Erickson's treatise intertwines and confuses two major, but separable, issues: whether there are basic tastes and how taste stimuli are encoded. The idea of basic tastes may reflect a natural process of concept formation. By only discussing two spatial coding schemes for taste, Erickson ignores the temporal dimension of taste responses and the contribution of neuronal cooperativity.

Building on the literature on hybrid organizations, this manuscript explores the relationship between the organizational activity of social enterprises backed by venture philanthropy investors and income inequality. Using Ashoka’s portfolio of Indian social enterprises as empirical context of Western venture philanthropy investing activity, our results suggest that Indian municipalities with social enterprises that have received venture philanthropy investments experience a decrease in income inequality level and when these social enterprises are dominated by a collectivistic organizational identity orientation the effect is (...) stronger. This work evaluated the structure of dreams in people affected by schizophrenia. The verbal reports of 123 schizophrenic patients were compared with 123 dream reports from a control group. In accordance with the Jungian conceptualization of, dreams as texts, dream reports were assessed using textual analysis processing techniques.Significant differences were found in textual parameters, showing that the dreams reports of schizophrenic patients differ from those of the control group. It is thus possible that schizophrenia probably underlies changes in the oneiric (...) production and dream reports. This work confirms the value of textual analysis in the study of oneiric material. Informed consent is an essential step in helping patients be aware of consequences of their treatment decisions. With surgery, it is vitally important for patients to understand the risks and benefits of the procedure and decide accordingly. We explored whether a written IC form was provided to patients; whether they read and signed it; whether they communicated orally with the physician; whether these communications influenced patient decisions. Adult postsurgical patients in nine general hospitals of Italy’s Campania Region were interviewed via (...) a structured questionnaire between the second and seventh day after the surgery at the end of the first surgical follow up visit. Physicians who were independent from the surgical team administered the questionnaire. The written IC form was given to 84.5% of those interviewed. All recipients of the form signed it, either personally or through a delegate; however, 13.9% did not know/remember having done so; 51.8% said that they read it thoroughly. Of those who reported to have read it, 90.9% judged it to be clear. Of those receiving the written consent form, 52.0% had gotten it the day before the surgery at the earliest 41.1% received it some hours or immediately before the procedure. The written IC form was explained to 65.6% of the patients, and 93.9% of them received further oral information that deemed understandable. Most attention was given to the diagnosis and the type of surgical procedure, which was communicated respectively to 92.8 and 88.2% of the patients. Almost one in two patients believed that the information provided some emotional relief, while 23.2% experienced increased anxiety. Younger patients and patients with higher levels of education were more likely to read the written IC form. The written IC form is not sufficient in assuring patients and making them fully aware of choices they made for their health; pre-operative information that was delivered orally better served the patients’ needs. To improve the quality of communication we suggest enhancing physicians’ communication skills and for them to use structured conversation to ensure that individuals are completely informed before undergoing their procedures. Despite that it is commonly accepted that migraine is a disorder of the nervous system with a prominent genetic basis, it is comorbid with a plethora of medical conditions. Several studies have found bidirectional comorbidity between migraine and different disorders including neurological, psychiatric, cardio- and cerebrovascular, gastrointestinal, metaboloendocrine, and immunological conditions. Each of these has its own genetic load and shares some common characteristics with migraine. The bidirectional mechanisms that are likely to underlie this extensive comorbidity between migraine and other (...) diseases are manifold. Comorbid pathologies can induce and promote thalamocortical network dysexcitability, multi-organ transient or persistent pro-inflammatory state, and disproportionate energetic needs in a variable combination, which in turn may be causative mechanisms of the activation of an ample defensive system with includes the trigeminovascular system in conjunction with the neuroendocrine hypothalamic system. This strategy is designed to maintain brain homeostasis by regulating homeostatic needs, such as normal subcortico-cortical excitability, energy balance, osmoregulation, and emotional response. In this light, the treatment of migraine should always involves a multidisciplinary approach, aimed at identifying and, if necessary, eliminating possible risk and comorbidity factors. (shrink)

IntroductionDuring the COVID-19 pandemic, healthcare workers in Italy have been exposed to an unprecedented pressure and traumatic events. However, no direct comparison with the general population is available so far. The aim of this study is to detail mental health outcomes in healthcare workers compared to the general population.Methods24050 respondents completed an on-line questionnaire during the contagion peak, 21342 general population, 1295 second-line healthcare workers, and 1411 front-line healthcare workers. Depressive, anxious, post-traumatic symptoms and insomnia were assessed. Specific COVID-19 related (...) potential risk factors were also considered in healthcare workers.ResultsDepressive symptoms were more frequent in the general population and front-line healthcare workers compared to the second-line healthcare workers groups. Anxiety symptoms showed a prevalence of 21.25% in the general population, 18.05% for second-line healthcare workers, and 20.55% for front-line healthcare workers. Insomnia showed a prevalence of 7.82, 6.58, and 9.92% for the general population, second-line healthcare workers, and front-line healthcare workers, respectively. Compared to the general population, front-line healthcare workers had higher odds of endorsing total trauma-related symptoms. Both second-line healthcare workers and front-line healthcare workers had higher odds of endorsing core post-traumatic symptoms compared to the general population, while second-line healthcare workers had lower odds of endorsing negative affect and dissociative symptoms. Higher total traumatic symptom score was associated with being a front-line healthcare worker, having a colleague infected, hospitalized, or deceased, being a nurse, female gender, and younger age.ConclusionThis study suggests a significant psychological impact of the COVID-19 pandemic on the Italian general population and healthcare workers. Front-line healthcare workers represent a specific at-risk population for post-traumatic symptoms. These findings underline the importance of monitoring and intervention strategies. (shrink)

This article argues that foreign multinational corporations in South Africa cannot evade an ethical choice, how best to exercise their leverage against apartheid? Disinvestment is only one, ambiguous option. MNCs need clear ethical goals and an effective strategy. Both arise from the political economy of the MNC . It involves 3 relationships, between the MNC parent and its subsidiary; the MNC home society and host society; and the MNC home state and host state. That political economy explains the MNC's dependency (...) and modernization effects . Those effects give foreigners some leverage against apartheid; but an effective and ethical MNC strategy is needed . It involves four goals: dismantling apartheid, a mixed economy, full democracy, and a negotiated peace . It suggests a sequence of MNC/home state options from Do Nothing or Divest to More Corporate Activism, Home State Support, and International Sanctions . Advances in neuroscience implicate reentrant signaling as the predominant form of communication between brain areas. This principle was used in a series of masking experiments that defy explanation by feed-forward theories. The masking occurs when a brief display of target plus mask is continued with the mask alone. Two masking processes were found: an early process affected by physical factors such as adapting luminance and a later process affected by attentional factors such as set size. This later process is called (...) masking by object substitution, because it occurs whenever there is a mismatch between the reentrant visual representation and the ongoing lower level activity. Iterative reentrant processing was formalized in a computational model that provides an excellent fit to the data. The model provides a more comprehensive account of all forms of visual masking than do the long-held feed-forward views based on inhibitory contour interactions. (shrink)

The recent takeover and merger trend cries out for ethical evaluation. This essay proposes a model for evaluating them in terms of their impact on a firm's immediate stakeholders: investors, owners, management and employees. Since mergers and takeovers are 'Transfers of Ownership of Firms' they entail a property ethic of ownership, control, securing stakeholder interests, and defining which stakeholders should exercise these rights. I use the model to evaluate two fictional cases, a friendly merger and a hostile takeover. The results (...) show that neither TOF serves all interests equitably. Since the control structure of the private firm is legitimized by its interest structure, I reason that both should be reformed. Both rest on a broader economic rationale; but it is controverted. Accordingly, the economic and ethical evaluation of TOFs, I conclude, both entail the democratic reform of the control structure of the firm. (shrink)

This study uses a Corpus Assisted Discourse Studies methodology to provide the first systematic analysis of how trust is discursively constructed in crypto-drug markets. The data come from two purpose-built corpora. One comprises all the forum messages posted on the flag ship crypto-drug market Silk Road during the years in which it traded on the hidden net. The other corpus comprises all the reports published by the United Nations Office on Drugs and Crime during the same period. Our analysis of (...) trust focuses on the identities of those buying and selling drugs. The findings reveal that the Silk Road community members regularly discussed vendors’ identities alongside a continuum of trust–risk calculation, explicitly identifying both ‘good’ and ‘bad’ practices and hence engaging in self-regulatory discourses, and mainly constructed drug users’ identities in relation to values of expertise, integrity and benevolence. The findings also suggest that hard law enforcement activity, such as crypto-drug market closure, may encourage technological innovation within these markets. Moreover, our results show a disconnect between the discursive reality of the policy-making documents we examined and the very crypto-drug markets that they seek to legislate. (shrink)

This article provides the first extensive study of Emanuel Swedenborg’s (1688–1772) views on Africans and slavery. Although significant scholarship has been devoted to Swedenborg’s influence on the British abolitionist movement in the 1780s-1790s, comparably little has been written on the ideas and context which inspired this influence in the first place. This article explores Swedenborg’s ties to networks and debates about African evangelization, colonization, and slavery during the neglected period of the Swedish Age of Liberty (1719–1772). It shows that Swedenborg (...) was the first Swede to condemn slavery, as early as 1741, explains why he regarded slavery as a divine punishment in the afterlife for European missionaries, and why he presented sub-Saharan Africans as superior, in contrast to the dominant dismissive views of Linnaeus, Bäck, Kant, or Buffon. Like most Lutherans of his time, Swedenborg did not advocate the abolition of slavery, yet within a generation his provocative views about African superiority and spiritual emancipation were used by his followers to articulate their abolitionist agenda. Swedenborg’s millenarian doctrines more broadly re-harnessed biblical traditions about Africa and tropes about the bon sauvage, in a counter-example to narratives about the trope’s decline in the second half of the eighteenth century. ABSTRACT In 1758 in London, Swedish natural philosopher and mystic theologian Emanuel Swedenborg published De Telluribus in Mundo nostro Solari, a treatise on the plurality of worlds and life on other planets. During the seventeenth and eighteenth centuries, these topics formed a heterogenous literary genre which encompassed theology, astronomy, philosophy and satire. In De Telluribus, Swedenborg made detailed claims of communication with extraterrestrial spirits in the afterlife, through which he sought to spread his theology to new audiences. The paper will (...) explore the role of De Telluribus in Swedenborg's career, explain its content and analyse its polarized reception. It will show that De Telluribus combined for the first time the literary codes of two popular genres during the period, namely those concerning the plurality of worlds and the dialogues of the dead. By doing so, the paper revises current scholarly understanding of Swedenborg by showcasing him as a versatile yet ill-fated recombiner of literary genres. More broadly, the paper will shed light upon previously unnoticed eighteenth-century literary interactions along with a wider overview on the reception of themes such as the plurality of worlds, mysticism and satire in Scandinavia and Germany. Discerning the motives that lead businesspeople to make ethical decisions in economic contexts is important, for it aids the moral evaluation of such decisions. But conventional economic theory has for too long assumed an egoist model of motivation, to which many contrast an altruist view of ethical choices. The result is to see business decision making as implying dilemmas. On the other hand, we argue, if one assumes multiple motives, economic and ethical, in ordinary business decisions, a more fruitful model (...) of ethical motivation in such decisions emerges. In this paper multiple motives are assumed to be the norm in a world of large organizations, complex decisions and stakeholder management. An example of a technology acquisition decision, with environmental overtones is presented in illustration of this approach. A method for discerning motives, primarily in terms of behavioural efficacy is presented. On this basis a two step approach to morally evaluating mixed motives in business decisions is proposed. First, the fit of motives with substantive ethical values should be ascertained, and then the efficacy of moral motives in yielding ethical behaviour and outcomes should be determined. This approach, we conclude, offers a much more concrete model of the actual role of moral motives in business decision making. It also signals the importance of moral learning in organizations. This essay suggests that the 21st century knowledge economy represents a moderate form of moral community. To show this I first clarify the ideas of moral community and a knowledge economy. The latter reflects the emergence of high volume, high speed, high precision (or +VSP) electronic communications and exchange networks, both of which embody the ethical value of reciprocity. One result has been the emergence of commercially oriented knowledge communities. Solving complex socio-technical problems, this paper claims, involves diverse knowledges (cognitive diversity), competing interests (social diversity), and pragmatism. To explain this view, this paper first explores two different cases: Canadian pulp and paper mill pollution and siting nuclear reactors in seismically sensitive areas of California. Solving such socio-technically complex problems involves cognitive diversity as well as social diversity and pragmatism. Cognitive diversity requires one to not only recognize relevant knowledges but also to assess their validity. The aim of this essay is to present a model of ethical technology management which assumes that elites who make the system design and development decisions should minimize the risks to stakeholders rather than maximize gains for their organizations. Given the unsettled state in ethical theory a familiar substantive Social, Economic, Environmental and Rights value set or ‘SEER’ ethic is presented. To enable foresight of the negative SEER effects of innovations a technology life cycle is introduced. A cognate issue life (...) cycle is presented to facilitate the ethical resolution of SEER issues associated with such effects. The resultant problem of increased front end load delays and costs, due to ongoing system redesign and stakeholder discussions is found to preferable to high ‘rear end load’ crisis costs, e.g., ofthe Ford Pinto, Exxon Valdez, Dalkon lUD Shield, and the Union Carbide Bhopal plant. Furthermore the model promises improved returns on the capital investments involved, indications for further research in ethics, economics and organizational theory are noted. (shrink)
